SUPREME COURT’S SPILT VERDICT ON HIJAB BAN, MUSLIM BOARD NOW APPEALS THE GOVERNMENT

The All-India Muslim Personal Law Board General Secretary Maulana Khalid Saifullah Rahmani appealed to the Government of Karnataka to revoke its Government Order in response to the Supreme Court's two-member bench's divided decision over the wearing of the hijab by females in schools.


 Speaking on the Supreme Court's two-judge bench decision on females wearing the hijab in schools, Rahmani claimed that Justice Dhulia's decision was consistent with both the principles of personal freedom and the Indian Constitution. 


"Justice Dhulia has focused on promoting girls' education and removing barriers to their education ”an aspect that is certainly welcomed and is missing from Justice Hemant Gupta's judgment," AIMPLB said in a statement.


The board also cautioned the Karnataka government that less emphasis is placed on the education of women in the nation, particularly among Muslims. As a result, the government shouldn't promote programmes that obstruct girls' access to education.


A bench comprising Justice Hemant Gupta and Justice Dhulia rendered the ruling. Justice Dhulia overturned the Karnataka High Court ruling and annulled the February 5 Karnataka government decree, while Justice Gupta rejected the pleas contesting the ruling.


The Supreme Court will now send the case to a larger bench in light of the two justices' differing opinions. The All-India Muslim Personal Law Board itself joined the case when it reached the Supreme Court and vigorously expressed its ideas, positions, and arguments. The Board will continue to fight for these young girls' right to wear the hijab with all of its might and willingness.
