US Introduces $250 Security Deposit on Student, Tourist and H-1B Visas Under New Enforcement Bill

Millions of travelers and temporary employees will be affected by the United States' decision to require a $250 Visa Integrity Fee for the majority of non immigrant visa categories, with only a few exceptions, such as student (F-1), tourist (B-1/B-2), work (H-1B), and exchange visitor (J-1). The new policy comes with a series of comprehensive immigration reforms which were enacted under One Big Beautiful Bill, which was approved by the US congress on 4 July 2025.


Being implemented as a security deposit in contrast to the conventional visa fee, this fee will become operative as early as 1 January 2026, as proclaimed in the official release made by US immigration authorities.


The $250 fee will be taken upon issuance of the visa and is meant to deter overstays of visas mainly so that the money is used to pursue enforcement activities. This is a deposit that is eligible to refund. Overstaying the visa into the country comes at the expense of the government. This is a charge that is meant to recoup such expenses said Opal Lee an immigration lawyer addressing the US media.


The bill states that the fee will be paid by nearly all applicants of non pimmigrant visas, with an exception of diplomatic and official visa (type A and G). The fee will be pegged at an inflationary rate per annum and the power to increase the fee will still lie with the department of homeland security to issue regulations.


Though the law makers in the US have sponsored the bill arguing that the action will enhance visa compliance and finance the guarding of the US borders, critics have raised the concern that it will burden the visitors who are not intending to violate the rules and also the international students. Others are worried that it could deteriorate US as a destination of higher education and tourist place.


It might be particularly expensive to students who intend to study in the United States (a number of whom already have to pay high amounts of tuition and living expenses). Likewise, the firms using foreign skilled workers registered on the H-1B programme can also be pushed to help or reimburse in this additional expenditure on their workers.


The lack of clarity on the process of getting a refund has also been an issue of concern as criticized by its users. The legislation has yet to give specifics as to how the refund will be carried out, how evidence of departure or adherence will be required and how this process will be lengthy.


The statute is a component of a larger bundle where it prescribes more Border Patrol and ICE personnel, growth of immigration detention hubs, and new border barriers undertaking. These are seen to enhance security of a country and curb illegal immigration.


As the deadline closes in, consular officers and other providers of immigration services are anticipated to release comprehensive advisory in the next few months to help applicants to plan accordingly in navigating the new requirement. Prior to this, students, travellers and visa holders are feeling anxious since they need more clarification.
