A Delhi court on Saturday postponed its decision on whether to take cognisance of the Enforcement Directorate’s chargesheet in the National Herald case. Special Judge Vishal Gogne moved the pronouncement to 16 December, extending the wait for the next legal step in the high-profile matter.
The ED’s chargesheet names Congress leaders Sonia Gandhi and Rahul Gandhi, along with the late party leaders Motilal Vora and Oscar Fernandes. Others listed include Suman Dubey, Sam Pitroda and the company Young Indian. The agency has alleged conspiracy and money laundering in connection with financial transactions linked to the National Herald newspaper. According to the investigation, the accused individuals and the company were involved in activities that the ED claims violated provisions of the Prevention of Money Laundering Act. The agency has maintained that the transfer of assets and the financial restructuring surrounding Associated Journals Limited raised concerns of unlawful gains and criminal conspiracy.
The court was scheduled to consider whether the material presented by the ED met the threshold required to take formal cognisance of the charges. However, the judge deferred the decision without providing further explanation in the open court. The matter has been under scrutiny for several years, with multiple rounds of inquiry, questioning and supplementary documentation. With the chargesheet now before the court, the next step will determine whether the case proceeds to the stage of summoning the accused.
Legal observers note that the deferred order keeps the proceedings in a holding pattern until mid December. The court is expected to examine the ED’s findings in detail before issuing its ruling on 16 December.
