Delhi Police opposes Tahir Hussain’s interim bail plea in Delhi riots case. He wants to contest and campaign in Delhi Assembly polls.
Tahir Hussain has moved an interim bail plea to contest and campaign in the upcoming Delhi Assembly Elections. Delhi Police argued before the Delhi High Court that though they are willing to grant him custody parole, they can’t support his interim bail.
Police said “the right to fight elections is not a fundamental right” and expressed serious concerns over the consequences of releasing him. They warned that his release will “create a threat to society” and feared that it will further polarize the society given the sensitive situation. They also called him “the principal figure in the riots,” and highlighted his role in the violence.
Hussain’s counsel argued that the application is for interim bail only to file his nomination and campaign for the elections. They said Hussain is willing to accept custody parole but interim bail is necessary for him to actively participate in the election process.
Justice Neena Bansal Krishna reserved the order and will pass it in chambers.
During Tahir Hussain’s bail hearing, Chetan Sharma for Delhi Police said “There are witnesses who will be threatened”.
Sharma further said “The right to fight elections is not a fundamental right,” and asked the Delhi High Court to reject the plea. He also said under UAPA where other accused have challenged the trial court’s order “The petitioner lacks the compassion to apply for bail.”
He pointed to the evidence recovered from Hussain’s residence “We are talking about 53 people dead and the petitioner is the main accused”.
Sharma said “Granting bail for 4-5 weeks will further polarize the situation”. Police opposed the bail as they don’t want to fuel the societal divisions.

Delhi Police has opposed the interim bail plea of AIMIM leader Tahir Hussain who is seeking bail to contest and campaign in the upcoming Delhi Assembly elections. Hussain, an accused in Ankit Sharma murder case, has sought bail from January 14 to February 9 to participate in the election process.
Tahir Hussain’s lawyer told the court that the nomination process has already started. He also referred to Rashid Engineer case during the hearing.
Besides this Tahir Hussain has also moved interim bail in other cases related to Delhi riots and Enforcement Directorate investigations.
