HERE'S WHY SUPREME COURT SAID IT COULDN'T RESTORE UDDHAV THACKERAY AS MAHARASHTRA CM

CJI refused to restore power of Udbhav Thackeray as the CM of Maharashtra

On Thursday, Uddhav Thackeray faced a big blow from Supreme Court as it gave the verdict that it cannot give the permission to restore Thackeray-led Maha Vikas Aghadi government. SC also stated that the discretion by the governor was not according to the constitution of India so it could not restore the state of affairs that existed previously.


     DY Chandrachud as the chief justice of SC along with five other judges of the bench gave the verdict that that then-Governor Bhagat Singh Koshyari "made a mistake in trusting on the resolution" of a faction of MLAs of Shiv Sena to conclude Thackeray had lost the support of the majority of MLAs. He also added "Exercise of discretion by the Governor was not in accordance with the Constitution."
