The Legal and Political Limits of Revoking Citizenship in the Case of Zohran Mamdani

The controversy around Zohran Mamdani, New York City's newly elected mayor, underscores the volatile intersection of politics, race, and law in modern America. Mamdani, who made history as the city's first Muslim and first South Asian mayor-elect, has found himself the target of fierce opposition from Republican lawmakers. They seek to question his citizenship status and aim to revoke it based on allegations tied to purported communist alliances and associations with entities they deem hostile. However, a close examination of US legal frameworks, naturalisation procedures, and constitutional protections reveals that these claims lack credible evidence and that stripping a citizen of their status is a legal maneuver rarely successful and fraught with procedural complexity.

Zohran Mamdani was born in Uganda and immigrated to the United States as a child in 1998. He became a US citizen in 2018 after following the legal process for naturalisation, which requires permanent residency for a sufficient period, a demonstration of good moral character, and an oath of allegiance to the United States. The Republican opposition, led by public figures like Andy Ogles, have alleged that Mamdani concealed communist ties during his application process and have branded him a "communist" and a "terrorist sympathizer." These accusations are contradicted by the facts: the organisation Mamdani is affiliated with, the Democratic Socialists of America, is not a communist party, and immigration law experts find no evidence Mamdani lied or withheld material information during his naturalisation.

Revoking citizenship through denaturalisation is an extraordinary measure used predominantly in cases involving fraud in the naturalisation process or direct involvement in terrorism. The government must meet a high burden of proof in court, demonstrating that the individual either illegally procured citizenship or committed willful and material misrepresentation. In Mamdani's case, experts highlight that no credible proof exists that he did not meet eligibility requirements at the time of his citizenship oath or that any omission was relevant enough to alter his naturalisation outcome. The claims by his political adversaries thus appear to be politically motivated rather than legally substantiated.

The attempt to block Mamdani from office also draws upon the 14th Amendment, which grants citizenship to all persons born or naturalised in the United States and promises equal protection. The argument that Mamdani aided enemies of the United States by supporting "pro-Hamas" groups and criticizing Immigration and Customs Enforcement (ICE) is a political weapon rather than a legal basis for disqualification. Any action to strip him of citizenship or prevent him from holding office would require a two-thirds vote in both houses of Congress and would almost certainly face challenges up to the Supreme Court. Given the constitutional protections and precedents, this effort stands on precarious ground.

Historically, denaturalisation in the United States has been rare and mostly confined to egregious cases like former Nazis who concealed their past to gain entry into the country. Although there has been a rise in denaturalisation cases under previous administrations, the threshold to achieve it remains stringent. If Mamdani's citizenship were revoked, he would revert to lawful permanent resident status, rendering him ineligible to serve as mayor. However, the absence of concrete legal grounds means this scenario is unlikely and could set a dangerous precedent of weaponizing citizenship revocation based on political differences.

This situation reflects wider political tensions and the use of citizenship as a tool for exclusion and delegitimisation. Attacking a newly elected official based on unproven claims about political ideology undermines democratic values and the integrity of the electoral process. Mamdani's victory represents a milestone of representation for historically marginalised communities, making attempts to thwart his mandate appear not only legally dubious but socially regressive.

In conclusion, the legal pathway to revoke Zohran Mamdani's citizenship is obstructed by lack of evidence, stringent judicial standards, and constitutional protections. Political opposition that seeks to exploit immigration status for partisan gain poses a threat to democratic norms and the principles of equal citizenship. It is essential to uphold the rule of law and resist attempts to undermine elected officials through baseless allegations and political intimidation. Mamdani's story is a testament to the enduring strength of American democracy and its capacity to embrace diversity, not a precedent for revoking citizenship on political grounds.
